1. Contractual object
PIN is an internet-based cross-platform communication and calendar service.
In principle, DailyFrame GmbH provides the «PIN» service free of charge. Additional functions may be purchased by means of the purchase function within the App.
2. Scope
These Terms of Use represent a legal contract between the User of the «PIN» Service (the «Customer» ) and the provider of the Service, DailyFrame GmbH («PIN» or «Provider»).
These Terms of Use apply to all the rights and obligations of the Contracting Partners when using the «PIN» Service.
To be valid, any variations from the individual provisions herein must be in writing.
3. Rights of Use
For the duration of this Contract the Customer obtains a non-exclusive and non-transferrable right, without a right of sub-licence, to use the Service and the software required to use it (the «App») for the stated contractual purpose and in consideration of these Terms of Use.
The Customer acquires rights of access to use the Service. A valid right of access is required for each User of the Service. The required access data will be provided to each User individually following agreement.
The App required for the Service is public and available free of charge. Activation and use of the App require valid access authorization. Valid access authorization is required for each device on which the App is to be activated and used.
The Customer may use the App solely to operate the PIN server, and the Service may only be used with the software approved for this purpose by the provider.
Any change to, adjustment of or reproduction of the software by the Customer, as well as unauthorized access to it, are prohibited. The App may be used solely for its intended purpose in compliance with all statutory and contractual obligations. In particular, the Customer shall prevent any use of PIN that could harm other customers or third parties.
4. Liabilities of the Customer
The Customer is liable for the use of the Service and for compliance with all statutory and/or regulatory obligations. In particular, the Customer Is liable for the confidentiality of his access data, passwords etc. The Customer shall prevent any unauthorized use of the Service and shall immediately notify PIN of any unauthorized use or access. The Customer shall render the Provider harmless from any claims by third parties brought against the Provider as a result of the User’s wilful breach of the rights of third parties or as a result of culpable conduct by the User towards the Provider, in breach of the law or the Contract.
5. Services of the Provider
The Provider shall render the Service at a state of the art level. In particular, the Provider shall endeavour to deliver all messages without delay. The Provider shall develop the software and the Service continuously. In doing so, he may introduce new functions and replace existing one with new ones pr remove any functions without replacing them. The Customer has a choice of various products which differ in their scope and level of performance The Provider is obliged to provide the service components defined in the licence packages. However, the Provider reserves the right to expand the scope of services or reduce and adjust it at any time. If the Customer or a User acting under his authority or a third party commit a culpable breach of legal regulations or these Terms of Use, the Provider may temporarily block the Services partially or completely. PIN assumes no liability for losses incurred by the Customer as a result of unauthorized access to our system. If the Service or the use of PIN breach the local laws and regulations of any country, we reserve the right to reduce our services in that country.
6. Charges and Payment
Charges for use are payable in advance. In the case of recurrent charges, billing is annual, monthly or weekly, depending on the user package. The current table of charges can be dived on the PIN website and within the app. The Provider reserves the right to adjust the charges and/or tariff steps to changed circumstances at any time. Charges are non-refundable except if this is required by law. The Customer is obliged to correctly provide all the details required for payment. PIN may deactivate or terminate service in the event of outstanding payments. The Customer is liable for the correct settlement of all taxes. PIN shall levy and charge taxes wherever required by law.
7. Duration of Contract, Termination
The Contract is concluded for an indefinite period. If there is no change to the price plan, licences remain valid without restriction. If payment of any one-off charges was agreed upon when concluding the Contract, an extension thereof shall not result in additional charges. Both Parties may terminate the Contract in writing at any time with one month’s notice as of the end of any month or as specified in the relevant contract package. In the event of premature termination of contract, no reimbursement of charges already paid is due.
8. Data Protection and Safety
The personal data collected during use of the Service are processed solely in compliance with the Swiss Federal Data Protection Law, other relevant legal regulations, Regulation (EU)2016/679 (GDPR) and our data protection declarations (Android-, Windows Phone- and iOS-App). The Provider shall process the data in compliance with the applicable jurisdiction. Messages shall be cached solely in encrypted form and erased following successful delivery. On his part, the Customer undertakes to comply fully with the statutory regulations governing the handling of personal data.
9. Liability and Restrictions of Liability
The delivery of direct messages in the Internet and especially to mobile devices may be delayed or prevented by circumstances outside the Provider’s control. These include (but are not confined to) the following: No reception, no connection to the Internet or to the Service, disruptions to the Internet of any kind (routing, DNS etc.) faults with the hardware and software of receives and network appliances, DDoS attacks. The Provider expressly denies any liability or duty of compensation if use of the service is restricted by the above circumstances or for other reasons. Under no circumstances can the Provider be made liable for losses incurred by customers or third parties as a result of the use, restricted use or impossible use of the Service or software. Claims for compensation are excluded in any case. Emergency services: PIN provides no access to emergency services (including police, fire brigade and ambulance). Users should therefore ensure that they can reach these emergency contacts via a secure mobile connection, landline or other link.
10. Concluding Provisions
The Provider may amend these Terms of Use as necessary. The Customer shall be notified of any amendments on the PIN admin page. In the absence of any message from the User to the contrary, amendments to the Terms of Use shall be deemed accepted after a period of 30 days. Should one or more provisions of these Terms of Use prove to be invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a binding legal regulation. This contract shall be governed by Swiss law, to the exclusion of the UN Sales Convention and the conflict of laws. The place of arbitration is the court applicable to the Provider’s registered business address.

The processing and protection of data conform to the current statutory regulations and Regulation (EU) 2016/679 (GDPR).
The PIN-App («App») was developed to leave as little metadata on a central server in Switzerland as possible. Therefore it is not absolutely necessary to provide one’s personal data in order to use the App. The user is identified via his mobile phone number, email and provided data. By providing your mobile phone number and email, you confirm in compliance with Article 8 GDPR that you are at least 16 years of age or you have permission from a parent or guardian. By using the App you consent to the collection, processing and use of data as described below.
